    GENERAL TERMS AND CONDITIONS

  1. This Website is owned and managed by Motso Tickets a Proprietary Limited Company created under the regulations of the Republic of Botswana, Registration No. BW00002542722, domiciled in Gaborone, Botswana.
  2. Motso Tickets is an online bus ticketing service. We do not operate any buses of our own.
  3. Any person (User) must be at least 18 years of age to use this website.
  4. The services offered by Motso Tickets can only be accessed by users who have read the General Terms and Conditions and have accepted them by clicking on the corresponding box provided for that purpose.
  5. By accepting the General Terms and Conditions, the User also agrees to the Terms of Service, the conditions to change tickets and the conditions for cancellations and refunds, contained in this Website.
  6. The User is responsible for their actions performed on the website and guarantees that the information that they provide on the Website is accurate and up to date.
  7. The User hereby consents to receive communications by SMS or calls from Motso Tickets with regard to services provided by them.
  8. The website offers the user access to information about the services of various Third Party Providers, which are Transport Operators so that the User can reserve and pay for their bus tickets through the Website.
  9. We cannot guarantee the integrity or accuracy of the results or to all other information that we present on our website and that is or has been made available to us by Third Party Providers.
  10. When displaying the offers from Third Party Providers, we do not assume responsibility for the availability of the service of the Third Party Providers at the time of booking or for the effective and flawless provision of the service contracted with the Third Party Providers
  11. LIMITED LIABILITY OF MOTSO TICKETS

  12. Motso Tickets Liabilities are limited to issuing a valid e-ticket for its network of Transport Operators.
  13. We cannot be held accountable for changes or problems in the service for which we are not responsible, therefore any question or complaint related to the quality of the Transport Operator service must be resolved with the Transport Operator itself, Motso Tickets being exempt from any responsibility
  14. Our liability does not include the following:
    • The operator’s vehicle not departing / reaching on time.
    • The bus operator’s employees being rude.
    • The operator’s seats etc. not being up to the customer’s expectation.
    • The operator cancelling the trip, changing the type of vehicle or changing the seat.
    • The baggage of the customer getting lost / stolen /damaged.
    • The non-functioning video, air conditioning and any such other services mentioned.
    • Technical delays, stops, bus changes and to any consequence that may result from it
    • Any other service for which we are not responsible
  15. By making a booking, the User understands Motso Tickets merely provides a technology platform for booking of bus tickets and the ultimate liability rests on the respective Transport Operator and not Motso Tickets.
  16. Thus the ultimate contract of service is between User and Transport Operator.
  17. RESERVATION OF TICKETS

  18. The tickets bought through this Website are electronic tickets.
  19. The bus ticket is confirmed instantly the corresponding payment has been received. The confirmation of a reservation, which contains all the necessary information, such as the description of the reserved Services and the price and the electronic ticket, will be sent to the User by email and sms.
  20. If the User does not receive a confirmation email or sms within 2 hours of making the reservation, he must send an email to info@motsotickets.com.
  21. Motso Tickets reserves the right to charge certain fees in the nature of convenience fees or service fees. Motso Tickets further reserves the right to alter any and all fees from time to time. Any such additional fees, including fee towards any modifications thereof, will be displayed to the User before confirming the booking or collecting the payment from such User.
  22. Motso Tickets does not accept reservations via text messages or by phone.
  23. Motso Tickets is not responsible for duplication of reservations made by the User through our Website. The User must contact the Transport Operator to resolve this issue.
  24. Motso Tickets understands that the information provided by the User is accurate and, therefore, is not responsible if the electronic ticket does not arrive due to an incorrect email address or contact phone number.
  25. It is the responsibility of the User to verify that the name that appears on their passport or identity document matches that of their ticket and/or purchase confirmation.
  26. It is possible to make changes to the names registered on an electronic ticket issued by Motso Tickets. The customer who made the purchase may make this request to the Transport Operator at least 1 hour before the departure.
  27. The Transport Operator reserves the right to change the customer’s seat number.
  28. The operator reserves the right to cancel/delay trips/events, change vehicles/venue and change seats due to unavoidable reasons.
  29. The cancellation policy is subject to change at the last minute and is at the discretion of Motso Tickets and the participating Third Party Providers.
  30. CHECK-IN AT THE BUS TERMINAL

  31. For local trips, all passengers must check-in at the counter of the bus Operator at least 30 minutes before the indicated time of departure.
  32. Passengers must present their Photo Identity proof mentioned in the “e-Ticket” at the time of boarding the bus. Failing to do so, they shall not be allowed to board the bus.
  33. LUGGAGE

  34. Each Transport Operator has its own rules related to baggage handling. Motso Tickets does not recognize any responsibility for the handling of the luggage of the passenger. The passenger can request more information about the handling of luggage from the relevant Transport Operator.
  35. CANCELLATIONS AND REFUNDS

  36. Cancellation of e-tickets is only allowed up to one hour before the schedule start time at origin of the Service.
  37. There will be No refund of tickets if the cancellation request is made less than 1 hour before the departure of the trip.
  38. Refunds are authorized and processed by the bus Operators and are subject to the Special Terms and Conditions of each Transport Operator.
  39. To request a refund, the passenger must contact the relevant Transport Operator.
  40. Any service fee charged by Motso Tickets is not refundable under any circumstances.
  41. Passengers will not be entitled to a refund if they are refused boarding due to:
    • Not being able to present the required documentation
    • Invalid or expired documents;
    • Not complying with the laws in force in the country;
    • Any other reason not caused by the Transport Operator or Motso Tickets.

    CONDITIONS TO CHANGE TICKETS

  42. If you need to make a change of date, route or time to your ticket, it is your responsibility to notify the relevant Bus Operator at least 1 hour before time on which your trip is scheduled to start.
  43. A fee may be imposed by the corresponding Transport Operator in the event that any changes are made to the reservation by the Passenger. To modify a reservation, the Transport Operator normally has to cancel the original reservation, which may result in charges imposed by the corresponding Transport Operator, which may include the total value of the booked trip; In addition, the Client may have to pay a difference for the cost of the new reservation.
  44. When you purchase transportation tickets through Motso Tickets, the non-cancellation of the ticket and the absence of the passenger(s) at the place of departure of the bus, will result in the Transportation Operator assigning the status of “no show” to the customer, resulting in the loss of reimbursement rights by the customer(s).
  45. The passenger can request the cancellation of the journey by contacting the Transport Operator.
  46. In case of a total or partial cancellation of a reservation, compensation may be imposed by the corresponding Transport Operator.
  47. When a cancellation affects more than one person included in the reservation, the corresponding cancellation fee will be applied to each person included in the reservation.
  48. In some cases, the cancellation compensation to be paid to the relevant Transport Operator may amount to the full value of the booked trip in which case no refund will be made to the Passenger.
  49. You must take into consideration the following conditions to cancel or change tickets:
  50. Cancellation Terms Cancellation Charges
    1 More than 48 hrs before the Schedule service start time at origin of the bus. No Charges
    2 From 48 hrs before and up to 24 hrs. before the Schedule service start time at origin of the bus. 10% of the actual fare
    3 From 24 hrs before and up to 2 hrs before the Schedule service start time at origin of the bus 25% of the actual fare
    4 Up to 1 hr before Schedule service start time at origin of the bus. 50% of the actual fare
    5 Less than 1hr before Schedule service start time at the origin of the bus No Refund

    FORCE MAJEURE

  51. There can be exceptional circumstances where Motso Tickets and / or the Transport Operators may be unable to honor the confirmed bookings due to various reasons like act of God, labor unrest, insolvency, a pandemic, an epidemic, business exigencies, government decisions, terrorist activity, any operational and technical issues or any other reason beyond their control.
  52. The User agrees that Motso Tickets being merely a facilitator of the services and products booked, cannot be held responsible for any such Force Majeure circumstance. The User has to contact the Transport Operator directly for any further resolutions and refunds.
  53. The User agrees that in the event of non-confirmation of booking due to any technical reasons (like network downtime, disconnection with third party platforms such as payment gateways, banks etc.) or any other similar failures, Motso Tickets obligation shall be limited refunding the booking amount, if any, received from the customer. Such refund shall completely discharge Motso Tickets from all liabilities with respect to that transaction. Additional liabilities, if any, shall be borne by the User.
  54. In no event shall Motso Tickets be liable for any direct, indirect, punitive, incidental, special or consequential damages, and any other damages like damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Website.
  55. COVID-19 RELATED TERMS AND CONDITIONS

  56. User agrees that due to recent outbreak of COVID-19 pandemic, which has been declared as a national disaster by the Government of Botswana, there may be instances, where the end service provider either cancels the booking or refuses to provide the services, as agreed with the User, by assigning or not assigning any specific reason for such refusal. Refusal of service may be due to the reasons including but not limited to the User:
    • exhibiting any symptoms associated with COVID 19.
    • refusing to comply with safety advisories, like wearing protective gear, complying with social distancing norms etc.
    • suffering of any ailment making the User vulnerable to the virus
    • posing a threat to the health and safety of others
  57. In such cases Motso Tickets will assume no liability for the refusal of service by the end service provider.
  58. The User further understands that due to the outbreak of COVID-19, the Botswana Government through its ministries, and statutory bodies have/may come up with detailed set of guidelines or standard operating procedure that a traveler will have to follow in order to undertake the travel.
  59. APPLICABLE LAW, JURISDICTION AND OTHER CONSIDERATIONS

  60. To the extent permitted by law, these terms and conditions and the provision of our services shall be governed by and construed in accordance with laws of the Republic Of Botswana.
